1. BASIC TERMS
1.1. Bank Card is a tool for performance of operations by its holder with the funds deposited with the bank which has issued the card in accordance with the legislation of the RF and the agreement with the bank of issue.
1.2. Ticket is a document executed on an accountable form granting the right to visit the Events.
1.3. Group Excursion Tour is a service of a group visit of the Museum (at least 5 people) providing for excursion services and realized by means of one-time purchase of the required number of tickets.
1.4. Electronic Ticket is the digital record of the ticket stored in a special database of the museum in the electronic form. The electronic ticket (voucher) printed out on ordinary paper may be used instead of the traditional form of the entrance ticket as it has a special barcode confirming the fact of booking and payment of the electronic ticket on the museum's website. Upon the Client's request the unused electronic ticket can be exchanged at the ticket office for a ticket executed on an accountable form.
1.5. Return is refund to the Client's Bank Card executed in accordance with the conditions of this Agreement.
1.6. Booking is one or more Tickets to one Event selected by the Client from the System and united in the System under one identification number on the grounds of which these Tickets are temporarily withdrawn (booked) from the general sales in the System.
1.7. Museum's Ticket Offices are the ticket office of all branches of the
1.8. Client (User) is an individual who has reached the age of 18 years or n authorized representative of a legal entity using a Bank Card on the grounds of an agreement with the bank of issue, Registered on the Website and using the Website to receive information and to Book Tickets.
1.9. Event is scientific-educational events, including visits of the Museum exhibitions and facilities, concerts in the hall or outdoors, excursions as well as any other events which may be visited only upon presentation of the Ticket.
1.10. Payment is transfer of money in the amount of the Cost of the Booking to the Museum's account by means of the Bank Card.
1.11. The System (Payment System) is the aggregate of the financial institutions contractually united and including TicketNet software, hardware and technical means ensuring informational and technological interaction necessary for settlements between the Buyers and the Seller.
1.12. Payment of the Booking is confirmation on the part of the System of the fact of debiting of the money from the Client's Bank Card.
1.13. Purchase is the fact of payment for the booking confirmed by the Electronic Ticket.
1.14. The Website is the Museum's Website at the electronic address of www.rusmuseum.ru and designed for placement of information and booking of the Tickets.
1.15. The Agreement is the present user agreement.
1.16. The cost of the Booking shall be determined by the parties for every particular Booking based on the effective costs of the Museum as of the time of execution of the Booking on the Website.
1.17. The Parties, the Party is the Museum, the Client.
1.18. The Museum is the State Russian Museum Federal State Budgetary Cultural Institution
1.19. Payment system regulations is the code of the documents regulating the activities of VISA and MasterCard payment systems.
2. SUBJECT OF THE AGREEMENT
2.1. The Agreement shall regulate the Client's behavior during receiving and executing of the Booking when purchasing the Tickets using the Website.
2.2. The Agreement is the agreement between the Client and the Museum (hereinafter the Party, the Parties) regulating the use of the Museum's Website by the Client.
2.3. The words and expressions highlighted with capital letters in the text of this Agreement shall have the meaning given to them in Section 1 of this Agreement, unless defined as such directly in the text.
3. BEGINNING OF THE AGREEMENT
3.1. The Agreement shall enter into force from the moment of pressing of the "Book" key when booking the tickets.
3.2. The Museum shall reserve the right to make amendments to this Agreement without additional notification of the Client and warns the Client (and the Client hereby accepts and agrees) that at every new Booking the Client shall become familiar with the text of the Agreement with regard to the amendments made. The text of the Agreement shall be permanently placed on the Museum's Website at http://rusmuseum.ru/about/tickets/.
3.3. The Client's consent with the terms and conditions of this Agreement shall be manifested by checking the relevant box of the registration form during registration on the Website.
4.1. During Registration on the Website the Client shall fill in all the boxes of the registration form (electronic questionnaire) on the Website when booking the Tickets.
4.2. The Client shall:
- state the current e-mail address owned by the Client;
- state the effective phone number owned by the Client;
- enter the Client's full name or the full name of another recipient of the Tickets in the Museum's Ticket Offices (if the booking is made not in the name of the Client);
- enter the verification code received at the e-mail address stated by him;
- express one's consent with the terms of the Agreement (see cl. 3.3 of this Agreement).
5. RIGHTS AND OBLIGATIONS OF THE CLIENT
5.1. The Client shall fully comply with the terms of this Agreement.
5.2. The Client shall be entitled to make a Booking on the Website and have the Payment returned in accordance with the terms of this Agreement.
5.3. The Client shall not reproduce, replicate, copy, resell the information from the Website, including the information about the Tickets offered on the Museum's Website and the prices of the Tickets, place it on other websites, and use it for commercial or advertising purposes.
5.4. The Client shall enter the Event both using the Tickets issued at the Museum's Ticket Office and on the grounds of the Electronic Ticket.
6. RIGHTS AND OBLIGATIONS OF THE MUSEUM
6.1. The Museum shall provide the Client with the possibility of Booking of the Tickets via the Museum's Website and their Return in accordance with this Agreement.
6.2. The Museum shall state the price for all the Tickets available for Booking on the Website. No Booking of the Tickets for welfare beneficiaries shall be provided on the Website.
6.3. The Museum shall have the right to change the price of the Tickets unilaterally, with the Cost of the earlier paid Bookings remaining unchanged.
6.4. The Museum shall have the right to send information messages to the Clients related with rendering of the services within the framework of the executed and paid for Booking using the means of communication stated by the Client during registration.
7. RULES OF PURCHASE AND RETURN OF THE TICKETS.
7.1. Payment and Return currency.
7.1.1. The currency of debiting of the money from the Client's Bank Card in accordance with the legislation of the RF shall be the Russian Ruble.
7.1.2. The currency of the Return of the money to the Client's Bank Card in accordance with the legislation of the RF shall be the Russian Ruble.
7.2. Procedure of making a purchase when paying with the Bank Card.
7.2.1. Upon selecting the necessary Tickets the Client shall start making the Booking by pressing "Book" key and shall go through all the stages of formation of the Booking stepwise.
7.2.2. At any time prior to final confirmation of the Booking and making the payment the Client shall be entitled to refuse from the unpaid Booking if any terms of the Agreement are inacceptable for him.
7.2.3. To pay for the Booking the Client shall be automatically redirected to the website of the System where the data of the Client's Bank Card are checked.
If the payment is made successfully, the amount of the cost of the Booking shall be debited from the Bank Card.
If the payment for the Booking has not been completed and/or has failed, the Client shall be entitled to execute a new Booking and make for it according to the procedure stated in cl. 7.2 of the Agreement.
7.2.4. In case of successful payment the Client shall receive a reference to the Electronic Ticket for print-out to the e-mail address stated in the process of making of the booking. This Electronic Ticket shall be printed out and produced on the day of the visit.
7.2.5. Should it be impossible to print out the Electronic Ticket independently, it is necessary to receive the Ticket made on an accountable form at the Museum's Ticket Office on the day of the visit. The Ticket shall be issued at the Museum's Ticket Office based on the number of the booking and the full name stated in the booking. The Museum shall not be liable for the consequences resulting from the Client's disclosure of the information about the number of his booking and the full name stated in the booking to third parties.
The Tickets where the time of the beginning of the tour (session) is stated shall be exchanged at least 30 minutes prior to the beginning of the Event. Other Tickets shall be exchanged at least 45 minutes prior to closing of the Museum.
7.2.6. In case of unilateral refusal of the Client from the Booking the Client shall have the right to the Return of the amount paid by him at the time of making of the Booking in accordance with cl. 7.7 of this Agreement.
7.3. Refusal to issue Tickets.
7.3.1. The Museum shall be entitled to refuse to issue the Tickets to the Client in case of:
a) receiving information from the System about performance or suspected performance of a fraudulent operation using the Client's Bank Card before the Return of the Payment to the Client's Bank Card;
b) if the Tickets of the relevant Booking were earlier issued to the Client;
c) impossibility to identify the recipient of the Tickets (discordance between the number of the booking and the full name of the person that made the booking);
d) return of the Payment for the relevant Booking to the Client's Payment Instrument prior to the Client's application to the Ticket Office to receive the Ticket of the Booking.
7.3.2. The Parties have agreed that in case of the Museum's refusal to issue the Tickets on the grounds stated in cl. 7.3.1 the fact of the non-receipt of the Tickets by the Clients according to the relevant Booking will be recognized by the Museum and the Client a fact of non-receipt of the Tickets through the Clients' fault and shall release the Museum from the Return of the amount of the payment for the relevant Booking to the Client.
7.3.3. If the Client has actually failed to receive the Tickets of the relevant Booking within the timeframes stated in cl. 7.2.5, this event shall provide sufficient grounds for the Museum to terminate its obligations under this Agreement unilaterally in accordance with the terms of this Agreement and to consider its obligations to the Client performed in full volume.
7.4. Payments Security.
7.4.1. The Client shall make Payments only by means of his own Bank Card.
7.4.2. The Payments Security shall be provided by means of the Acquirer Bank functioning on the basis of modern protocols and technologies developed by the international payment systems of Visa International and MasterCard Worldwide (3D-Secure: Verified by Visa, MasterCard SecureCode). The received confidential data of the Card Holder shall be processed in the processing center of the Acquirer Bank certified according to the PCI DSS Standard. The security of the transmitted information shall be provided by means of modern protocols of security provision in Internet.
7.5. Cancellation of the Booking.
7.5.1. The Museum shall be entitled to cancel the Booking in the cases specified in cl. 7.7.3.
7.5.2. In case of non-receipt of the confirmation of the successful Payment from the System the Museum shall be entitled to cancel the Booking within 2 (two) hours after its execution by the Client on the Website.
7.5.3. The Museum shall be entitled to cancel the Booking in case of a technical failure of the software and hardware complex during execution of the Booking. In this case the cost of the Booking shall be returned to the Bank Card with which this Booking was paid for.
7.6. Informational support of the Client.
7.6.1. Should questions arise, the Client may apply to the Museum by e-mail to the address: firstname.lastname@example.org or support service by calling the number +7 981 905 31 20 (in the museum's opening hours)
7.7. Rules of return
7.7.1. Rules of the Payment Return upon the Client's request prior to the exchange of the Electronic Ticket (voucher) for a Ticket at the Ticket Office of the Museum.
220.127.116.11. The Payment for the paid Booking shall be returned only for the bookings made on the Museum's Website by means of the Bank Card and not received at the Museum's Ticket Offices.
18.104.22.168. To have the Payment returned the Client shall fill in an Application in the electronic format. ("Application" reference for downloading of the application form in MS Office format is in the Information) and e-mail it to the address: email@example.com
22.214.171.124. The request for the Payment Return shall be processed on business days from
126.96.36.199. In case of acceptance of the request for Return of the Payment for the Tickets for an individual visit of the Museum less than 3 (three) hours before the beginning of the Event the Museum shall reserve the right not to return the cost of the Tickets to the Client.
188.8.131.52. In case of acceptance of the request for Return of the Payment for a Group Excursion Tour less than 7 (seven) days before the beginning of the Event the Museum shall reserve the right not to return the cost of the Tour to the Client.
7.7.2. Rules of Return of the cost of the Tickets purchased by means of the Bank Card on the Website and received at the Ticket Offices of the Museum.
184.108.40.206. The Return of the cost of the Tickets shall be executed only at the Ticket Offices of the Museum.
220.127.116.11. The Return of the cost of the Ticket shall be made only to the Bank Card from which the Payment was made.
18.104.22.168. The rules of cl. 7.7.2 of the Agreement shall not apply to the cases of purchase of group excursion tours.
22.214.171.124. To have the cost of the Ticket returned the Client shall fill in an Application (to be issued at the Ticket Office) stating the surname, given name, patronymic, the number of the Electronic Ticket, passport number, e-mail address and number of the Bank Card from which the Payment was made, date of the booking, booking amount and ticket number.
To execute the Return the Client shall produce the identity document and the Ticket.
7.7.3. Rules of return of the Tickets at the initiative of the Museum.
126.96.36.199. If the Payment is to be returned in case of a cancelled event or in case of substitution of the event if the Tickets are to be returned as well as in case of occurrence of technical failures causing incorrect execution of the Booking or making of the Payment, the Museum shall cancel the Booking and return the Payment to the Client in full volume.
7.7.4. The Parties have agreed that the Payment Return by the Museum with regard to the relevant Booking in accordance with the terms of this Agreement and/or the Rules of International Payment Systems and the legislation of the RF shall be deemed by the Parties to be an event providing sufficient grounds for the Museum to terminate its obligations under this Agreement and to consider its obligations to the Client fulfilled in full volume.
7.8. Payment Return Date.
The Payment Return Date shall be the date of debiting of the money from the Museum's account. The Museum shall not be liable for further passage of the money.
8. CONFIDENTIALITY OF INFORMATION
8.1. The Museum shall not disclose the information received from the Client. Provision of the information by the Museum to the persons acting on the grounds of an agreement with the Museum for performance of the obligations to the Client shall not considered violation. The Museum shall provide access to the Client's personal data only to the employees, contractors and agents that need this information to provide functioning of the Website and to render services to the Client.
8.2. The Client's personal data shall be processed in compliance with the legislation of the RF. The Museum shall process the Client's personal data with a view to rendering of the services to the Client, verification, study and analysis of such data and communication with the Client. The Museum shall take all the necessary measures to protect the Client's personal data against unauthorized access, dissemination, modification, disclosure or destruction.
8.3. When agreeing with the User Agreement on the Website the Client gives his consent to processing of the personal data both with or without using automated facilities, including gathering, systematization, accumulation, storage, specification, use, dissemination 9inlcuding transfer), impersonation, blocking, destruction of the personal data provided by the Client in connection with performance of this Agreement as well as other actions stipulated by the Federal Law dd. 27.07.2006 No. 152-FZ "On Personal Data".
8.4. The Museum shall not verify the reliability of the personal data provided by the Client and shall not control their relevance but shall proceed from the fact that the Client provides reliable and sufficient personal data on the items offered in the Registration form and maintains the relevance of this information. The Client shall assume full liability for the consequences of provision of unreliable or invalid personal data.
8.5. The Museum shall be entitled to use the information provided by the Client, including personal data, with a view to ensuring compliance with the requirements of the applicable legislation (including prevention and/or suppression of unlawful and/or wrongful acts of the Client). The information provided by the Client may be disclosed only in accordance with the applicable effective legislation by an order of the court, law-enforcement bodies and in other cases stipulated by the legislation.
9. LIMITATION OF LIABILITY
9.1. The Client shall use the Website and the functionality provided by it at his own risk. The Museum shall not assume any liability, including liability for conformity of the Website to the Client's purposes and expectations.
9.2. The Museum shall assume no liability under any agreements between the Client and third parties.
9.3. The Museum shall be entitled at any time unilaterally to terminate the work of the Website in general or with regard to part of its functions without prior notification of the Client. The Museum shall assume no liability for temporary or permanent termination of the work of the Website.
9.4. The Museum shall make every possible effort to ensure normal operability of the Website; however, the Museum shall assume no liability for a failure to perform or improper performance of the obligations under the Agreement to the Client with regard to compensation of the losses (damage), direct or consequential, occurring due to the impossibility to use the Website.
9.5. In case of occurrence of force majeure circumstances as well as accidents or failures of the software and hardware complexes of the third parties cooperating with the Museum or the actions (inaction) of third parties aimed at suspension or termination of functioning of the Website, the work of the Website may be suspended without any notification of the Client.
9.6. The Museum shall assume no liability for the timeframes of making of payments by banks and other organizations, including return of Payments to the Client.
9.7. Under any circumstances the Museum's liability to the Client shall be limited by the cost of the Tickets purchased by the Client.
9.8. The Parties shall be released from responsibility for complete or partial nonfulfillment of their obligations if such nonfulfillment resulted from force majeure circumstances emerging after the Agreement came into force as a result of extraordinary events which the Parties could not have reasonably foreseen and prevented.
9.9. The Museum shall assume no liability for the disputes and differences regarding Payments arising between the Client and the System and/or any credit institution.
10. FINAL PROVISIONS
10.1. This document is an exhaustive Agreement between the Client and the Museum and determines the conditions of using the Website. In case of arising differences the text of the Agreement placed on the Website will have priority over any other text of the Agreement.
10.2. In the cases not specified in the Agreement the relations between the Museum and the Client shall be regulated by the legislation of the RF.
10.3. In case of arising differences and disputes with
regard to the Agreement and its scope the Museum and the Client shall make
every possible effort to resolve them through negotiations. In case of
impossibility to resolve the disputes through negotiations they will be
resolved in the Arbitration Court of Saint Petersburg and
10.4. The Client hereby confirms that he has studied and fully accepts (without any additional reservations) the terms of this Agreement. The Client hereby commits to comply with all the terms and provisions of this Agreement in full volume in his relations with the Museum.
